TERMS AND CONDITIONS

These Client Terms and Conditions (“Terms”) govern travel-planning, booking, and related services provided by Vuex Travel (“Vuex Travel,” “we,” “us,” or “our”) to the traveler or purchaser (“Client,” “you,” or “your”).

By completing a booking with Vuex Travel, you acknowledge that you have had the opportunity to review these Terms before completing your purchase and that you agree to be bound by them, together with the applicable terms and conditions of the airline, cruise line, hotel, tour operator, wholesaler, destination supplier, insurance provider, and other travel suppliers associated with your reservation.

  1. VUEX TRAVEL’S ROLE

Vuex Travel is a travel agency and travel booking service.

Our role is primarily to assist with arranging and booking travel services requested by the Client, including, as applicable:

  • Flights;
  • Hotels and accommodations;
  • Cruises;
  • Tours and excursions;
  • Vacation packages;
  • Transportation;
  • Group travel;
  • Travel-related activities; and
  • Other travel services available through our suppliers.

Vuex Travel does not own, operate, manage, or control the airlines, cruise lines, hotels, tour operators, transportation companies, excursion providers, insurance companies, or other third-party travel suppliers used to fulfill your itinerary.

Vuex Travel’s responsibility is limited to the travel-agency services we agree to provide, including properly processing bookings and payments, communicating booking information received from suppliers, and providing reasonable assistance with travel arrangements when appropriate.

Vuex Travel does not guarantee the performance, safety, quality, availability, schedule, condition, or conduct of any third-party travel supplier.

Nothing in these Terms excludes responsibility that applicable law requires Vuex Travel to accept.

  1. TRAVELER ASSUMPTION OF RISK AND PERSONAL RESPONSIBILITY

Travel involves inherent risks and uncertainties.

By booking and participating in travel, you acknowledge that you are voluntarily choosing to travel and accept the ordinary and inherent risks associated with travel, including risks associated with transportation, lodging, activities, destinations, weather, illness, infectious diseases, accidents, delays, cancellations, and circumstances beyond Vuex Travel’s reasonable control.

You are responsible for your own health, safety, medical decisions, personal property, conduct, and fitness to travel.

You are also responsible for the health, safety, documentation, and travel eligibility of any person traveling under your reservation to the extent applicable to you.

Vuex Travel does not provide medical advice and cannot determine whether you or another traveler is medically fit to travel.

You should consult an appropriately qualified healthcare professional regarding any medical condition, medication, vaccination, testing, physical limitation, pregnancy-related concern, infectious disease, or other health issue that may affect your ability to travel.

Nothing in this section is intended to release Vuex Travel from liability that cannot legally be released or waived.

  1. TRAVEL DOCUMENTS AND ENTRY REQUIREMENTS

The Client is solely responsible for obtaining and maintaining all documents and approvals necessary for travel.

These may include:

  • Valid passports;
  • Visas;
  • Transit visas;
  • Entry permits;
  • Vaccination records;
  • Health certificates;
  • Testing documentation;
  • Government-required forms;
  • Identification;
  • Immigration documentation; and
  • Other documents required by the destination or travel supplier.

Requirements may vary according to nationality, destination, transit location, age, health circumstances, and other factors.

You are responsible for independently verifying the requirements that apply to you and every traveler on your reservation before departure.

Vuex Travel may provide information obtained from government authorities or travel suppliers as a courtesy. However, information may change after it is provided.

Vuex Travel does not guarantee admission to a destination or that a traveler will satisfy the requirements of a foreign government, airline, cruise line, hotel, or other supplier.

  1. COVID-19, INFECTIOUS DISEASES, AND HEALTH RESTRICTIONS

COVID-19 and other infectious diseases may affect travel.

Requirements may include testing, vaccination, health documentation, quarantine, isolation, screening, masking, or other measures imposed by governments or travel suppliers.

Requirements may change without notice.

If you are unable to travel because of COVID-19, exposure to COVID-19, illness, testing, vaccination requirements, quarantine, isolation, government restrictions, airline restrictions, cruise restrictions, destination restrictions, or another health-related circumstance, you are responsible for the resulting expenses to the extent permitted by applicable law and the applicable supplier’s terms.

These expenses may include:

  • Additional hotel accommodations;
  • Quarantine or isolation accommodations;
  • Transportation;
  • Meals;
  • Medical expenses;
  • Testing;
  • Change fees;
  • Cancellation penalties;
  • Missed services;
  • Additional nights;
  • Emergency transportation; and
  • Other travel-related expenses.

Vuex Travel is not responsible for a Client’s health, medical treatment, medical outcome, quarantine, isolation, illness, exposure, or decision to travel.

Travelers who are concerned about COVID-19 or another health condition should consult a qualified healthcare professional before traveling.

  1. TRAVEL INSURANCE

VUEX TRAVEL STRONGLY RECOMMENDS THAT ALL CLIENTS PURCHASE APPROPRIATE TRAVEL INSURANCE BEFORE TRAVEL.

Travel insurance may provide coverage for certain unexpected circumstances, depending on the policy.

Clients should determine whether their insurance provides appropriate coverage for:

  • Trip cancellation;
  • Trip interruption;
  • Illness;
  • COVID-19;
  • Medical emergencies;
  • Emergency evacuation;
  • Quarantine;
  • Travel delays;
  • Missed connections;
  • Lost or delayed baggage; and
  • Other risks associated with the Client’s itinerary.

Vuex Travel does not guarantee that travel insurance will cover any particular claim, illness, cancellation, COVID-19-related event, medical expense, or travel disruption.

Insurance coverage is determined solely by the insurance policy and insurance provider.

If you purchase travel insurance, you are responsible for reading and understanding the policy, exclusions, conditions, deadlines, and claim procedures.

If you decline travel insurance, you acknowledge that you may be personally responsible for expenses that could potentially have been covered by insurance.

  1. TRAVEL INSURANCE CLAIMS

Vuex Travel is not the insurance company and does not determine whether a claim is covered.

Clients must submit insurance claims directly to their insurance provider in accordance with the insurance company’s procedures.

Vuex Travel is not responsible for:

  • Approving or denying an insurance claim;
  • Determining coverage;
  • Processing an insurance claim;
  • Paying an insurance claim; or
  • Resolving disputes between the Client and the insurance provider.

Where reasonably possible, Vuex Travel may provide booking documentation requested by the Client or insurance provider, but providing documentation does not make Vuex Travel responsible for the claim.

  1. STANDARD CANCELLATION POLICY

Unless a specific written supplier policy or booking agreement provides otherwise:

Bookings canceled after five (5) business days from the date the applicable deposit is received are non-refundable to the extent permitted by the applicable supplier terms and applicable law.

Cancellation fees and penalties may apply based on the applicable travel supplier’s terms.

Certain suppliers may impose stricter cancellation policies, including immediate non-refundable deposits or full payment requirements.

The specific cancellation terms provided with your booking control the cancellation of that reservation.

Clients should review the cancellation terms before making payment.

  1. CANCELLATIONS DUE TO ILLNESS, WEATHER, COVID-19, OR OTHER EVENTS

Cancellation because of illness, COVID-19, exposure, weather, personal circumstances, emergencies, work obligations, missed transportation, or other unexpected events does not automatically create a right to a refund from Vuex Travel.

Refunds, credits, rebooking, or cancellation waivers are determined by the applicable supplier and applicable law.

Travel insurance is the recommended method of protection against many unexpected travel losses.

Vuex Travel does not promise that an insurance policy will cover any particular circumstance.

  1. CHANGE OR CANCELLATION AFTER TRAVEL HAS COMMENCED

Once travel has commenced, changes or cancellations may result in penalties, additional charges, or loss of unused services.

There is no automatic refund for unused travel services.

Any refund or credit will depend on:

  1. The applicable supplier’s terms;
  2. The specific reservation;
  3. The reason for the unused service; and
  4. Applicable law.

Vuex Travel does not guarantee reimbursement for unused hotel nights, tours, flights, cruises, transfers, excursions, or other services.

  1. QUOTES, RATES, AND PRICE VARIATIONS

Vuex Travel’s quotation system may provide access to live and static pricing from travel suppliers.

Airlines, cruise lines, hotels, wholesalers, tour operators, and other suppliers may:

  • Sell out;
  • Change prices;
  • Withdraw inventory;
  • Change availability;
  • Change taxes or fees;
  • Change inclusions;
  • Withdraw promotional rates; or
  • Correct pricing errors.

A quote is not a guarantee that a particular price or inventory will remain available until the Client completes the booking and payment requirements.

If the price, availability, or inclusions change before the booking is processed, Vuex Travel will notify the Client when reasonably possible.

If the Client does not wish to proceed at the revised price, the Client may decline the revised booking before the transaction is processed, subject to any applicable supplier terms.

Once a booking has been confirmed, a later promotion or special rate generally cannot be applied retroactively unless the supplier permits it.

  1. PRICE INCREASES AFTER BOOKING

Certain travel suppliers may change prices, taxes, fees, surcharges, or other charges after a booking is made when permitted under the applicable booking terms.

If a supplier or wholesaler imposes a legitimate additional charge that is contractually permitted, the Client may be responsible for the additional amount.

Vuex Travel is not responsible for supplier-imposed increases, government taxes, currency fluctuations, fuel surcharges, or other charges outside Vuex Travel’s reasonable control, except where applicable law provides otherwise.

  1. DEPOSITS AND FINAL PAYMENTS

Travel deposits and payment schedules vary by supplier and itinerary.

The applicable deposit amount, payment schedule, cancellation deadline, and final payment date will be communicated with the booking when applicable.

Failure to make the required payment by the applicable deadline may result in cancellation of the reservation and forfeiture of amounts paid, subject to the applicable supplier terms and applicable law.

Certain suppliers may automatically cancel reservations when final payment is not received by the required deadline.

Deposits may be non-refundable.

Different deposit conditions may apply to certain hotels, cruises, tours, group trips, packages, and other travel products.

  1. BOOKINGS WITHIN 45 DAYS OF TRAVEL

Bookings made within forty-five (45) days of the scheduled departure date may require full payment at the time of booking.

Late booking or expedited service fees may apply when disclosed before payment.

Availability and pricing may be limited for late bookings.

  1. AIRLINE BOOKINGS

Airline reservations are subject to the applicable airline’s fare rules and terms and conditions.

Many airfares are restricted, non-refundable, or non-transferable, but the exact rules depend on the fare purchased.

Airline change, cancellation, name-correction, baggage, seat, and other fees may apply.

Vuex Travel does not control airline schedules, aircraft, staffing, baggage handling, delays, cancellations, or operational decisions.

However, Vuex Travel will comply with applicable legal obligations concerning airline transactions and refunds.

Where federal law or applicable airline rules provide a refund or other remedy, those rights are not waived by these Terms.

  1. AIRLINE CANCELLATIONS, SIGNIFICANT CHANGES, AND DELAYS

If an airline cancels a flight or makes a significant change, the Client’s rights may be governed by federal law, the airline’s applicable policies, and the fare terms.

Where applicable law provides a right to a refund, Vuex Travel will not use these Terms to eliminate that right.

For airline cancellations, delays, baggage problems, or operational issues, the Client may need to communicate directly with the airline for immediate assistance while traveling.

Vuex Travel may assist with the booking where reasonably possible, but Vuex Travel does not control the airline and cannot guarantee the airline’s decision, schedule, reimbursement, baggage resolution, or operational response.

  1. AIRLINE BAGGAGE

Baggage allowances, fees, delays, loss, and damage are governed primarily by applicable airline policies and applicable law.

Travelers should review the baggage rules of the airline operating each flight.

For baggage problems occurring during travel, travelers should promptly report the issue to the airline and obtain the appropriate documentation.

Travel insurance may provide additional protection depending on the policy.

  1. PAYMENT AUTHORIZATION

By providing payment information and completing a booking, the Client authorizes Vuex Travel to process the amounts disclosed and authorized for the selected travel services and applicable disclosed fees.

Where the Client has expressly authorized a future or scheduled payment, Vuex Travel may process that payment according to the agreed payment schedule.

The Client is responsible for maintaining sufficient funds or available credit for scheduled payments.

Failure to provide payment by the applicable deadline may result in cancellation, penalties, loss of deposits, or loss of availability.

The Client’s bank or payment provider may charge separate currency-conversion, foreign-transaction, or other fees.

  1. PAYMENT METHODS

Available payment methods and applicable processing fees will be disclosed to the Client before payment.

Current payment methods may include:

PayPal: A 4% service fee may apply where disclosed before payment.

Venmo: No Vuex Travel transaction or service fee is currently charged, unless otherwise disclosed.

Cash App: No Vuex Travel transaction or service fee is currently charged, unless otherwise disclosed.

Payment-provider fees, bank fees, currency-conversion fees, chargeback fees, or other third-party fees may be outside Vuex Travel’s control.

  1. TRAVEL VOUCHERS AND CONFIRMATIONS

Travel vouchers, confirmations, tickets, and final travel documents may be issued according to the applicable supplier’s procedures.

A reservation is not necessarily fully confirmed merely because a Client has requested a booking.

The Client should rely on the final confirmation issued by Vuex Travel or the applicable supplier.

  1. GROUP TRAVEL

Group travel may have separate payment, cancellation, rooming, and deadline requirements.

Unless otherwise stated in the specific group contract:

  • The remaining balance is due sixty (60) days before departure;
  • Deposits may be non-refundable;
  • Cancellation penalties may apply;
  • Supplier cancellation policies apply;
  • Late-booking fees may apply; and
  • Travelers are responsible for complying with the group’s payment deadlines.

The specific group-trip terms provided for that trip control where they differ from these general Terms.

  1. GROUP ROOMING AND ROOMMATE ARRANGEMENTS

For group trips where roommate matching is offered, Vuex Travel may make reasonable efforts to assist travelers with roommate arrangements.

Roommate matching is not guaranteed.

If a suitable roommate cannot be identified, the Client may be responsible for the applicable single-occupancy cost if single occupancy is required under the group arrangement.

Clients must confirm their room type and occupancy arrangements before making a deposit.

Roommate arrangements are subject to availability and may change if a roommate cancels.

If one or more roommates cancel, the remaining traveler(s) may be responsible for any increased occupancy cost, revised room rate, or cancellation fees imposed by the supplier.

Vuex Travel is not responsible for ordinary differences in roommate preferences, habits, schedules, or lifestyle, including:

  • Cleaning habits;
  • Sleeping schedules;
  • Snoring;
  • Personal preferences;
  • Noise preferences;
  • Personal organization; or
  • Other ordinary differences between travelers.

Travelers are expected to treat roommates and share accommodation respectfully.

Roommate Courtesy Guidelines

  1. If you open it, close it.
  2. If you break it, admit it.
  3. If you borrow it, return it.
  4. If you value it, take care of it.
  5. If you make a mess, clean it up.
  6. If it belongs to someone else, ask permission before using it.
  7. If you turn it on, turn it off.
  8. If you cannot fix it, contact the appropriate person or provider.
  9. If you move it, put it back.
  10. Respect reasonable personal boundaries and privacy.

Vuex Travel may assist with communication concerning a roommate issue when reasonably possible, but Vuex Travel is not responsible for ordinary interpersonal disputes or personal conflicts between roommates.

  1. TRAVEL ADVISORY AND PLANNING SERVICES

Travel-advisory, planning, consultation, itinerary design, administrative, or other professional service fees may apply.

Applicable fees will be disclosed to the Client before payment.

Service fees are non-refundable once the applicable service has been provided, except where required by applicable law or otherwise expressly stated in writing.

A service fee does not guarantee that the Client will ultimately purchase travel or that a supplier will approve a reservation.

  1. SUPPLIER TERMS CONTROL THIRD-PARTY SERVICES

Travel suppliers have their own contracts, rules, cancellation policies, refund policies, health requirements, baggage policies, payment requirements, and conditions of carriage.

The Client agrees to comply with the applicable supplier terms.

Vuex Travel cannot change a supplier’s policy unless the supplier authorizes the change.

Where supplier terms govern the supplier’s services, those terms control the applicable service.

  1. EVENTS BEYOND VUEX TRAVEL’S REASONABLE CONTROL

Vuex Travel is not responsible for losses, delays, cancellations, interruptions, or additional expenses caused by circumstances beyond our reasonable control, including:

  • Weather;
  • Hurricanes;
  • Natural disasters;
  • Pandemics or epidemics;
  • COVID-19;
  • Government restrictions;
  • Border closures;
  • War;
  • Terrorism;
  • Civil unrest;
  • Strikes;
  • Labor disputes;
  • Transportation failures;
  • Airline cancellations;
  • Cruise cancellations;
  • Hotel closures;
  • Supplier insolvency;
  • Airport closures;
  • Political events; or
  • Other extraordinary circumstances beyond Vuex Travel’s reasonable control.

This section does not eliminate any rights or responsibilities that applicable law requires.

  1. PERSONAL PROPERTY AND VALUABLES

Travelers are responsible for their passports, money, electronics, luggage, jewelry, medications, and other personal property.

Vuex Travel is not responsible for loss, theft, damage, or delay involving personal property except to the extent applicable law requires otherwise.

Travelers should review the baggage and personal-property coverage available through their travel insurance and applicable transportation provider.

  1. CLIENT CONDUCT

Clients are expected to comply with applicable laws, supplier rules, destination regulations, and reasonable conduct requirements.

Vuex Travel may decline to make or continue an arrangement where necessary because of unlawful conduct, abusive conduct, fraud, payment disputes, safety concerns, or supplier requirements.

Where a supplier removes, refuses, or denies service to a traveler, Vuex Travel does not control the supplier’s decision.

  1. ACCURACY OF CLIENT INFORMATION

The Client is responsible for providing accurate information when making a booking.

This includes:

  • Legal names;
  • Dates of birth where required;
  • Passport information;
  • Contact information;
  • Travel dates;
  • Rooming information;
  • Special requests; and
  • Other information required to complete the reservation.

Errors supplied by the Client may result in additional fees, cancellation, denied boarding, or other consequences.

Clients should carefully review confirmations immediately after receiving them and report errors promptly.

  1. SPECIAL REQUESTS

Vuex Travel may communicate special requests to suppliers, including requests relating to seating, rooms, meals, accessibility, celebrations, or other preferences.

A special request is not a guarantee.

Only services specifically confirmed by the applicable supplier should be considered guaranteed.

  1. COMPLAINT AND INCIDENT REPORTING

Clients should report problems as soon as reasonably possible while the problem is occurring.

This may include:

  • Injuries;
  • Hotel problems;
  • Flight problems;
  • Cruise problems;
  • Missed services;
  • Cancellations;
  • Baggage problems;
  • Supplier service issues; or
  • Other significant travel concerns.

Where appropriate, the Client should first report the issue to the supplier responsible for providing the service so that the supplier has an opportunity to correct the problem.

The Client should retain receipts, photographs, reports, correspondence, and other supporting documentation.

  1. VUEX TRAVEL COMPLAINT PROCESS

If a client has a complaint concerning Vuex Travel’s services, the Client should first contact the travel advisor who handled the booking.

The Client should provide:

  • Name;
  • Booking number;
  • Travel dates;
  • Description of the concern;
  • Relevant correspondence; and
  • Supporting documentation.

If the concern is not resolved, the Client may submit a formal complaint by email to:

Suggested subject:

Complaint – [Client Name] – Booking Reference [Booking Number]

Vuex Travel will review complaints in a reasonable manner and may request additional information.

Vuex Travel will make reasonable efforts to communicate with the Client regarding the review.

A complaint does not automatically create a right to a refund.

Refunds remain subject to the applicable booking terms, supplier policies, and applicable law.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Vuex Travel is not responsible for the acts, omissions, negligence, insolvency, delays, cancellations, schedule changes, failures, injuries, losses, damage, or other conduct of independent third-party travel suppliers.

This includes airlines, cruise lines, hotels, tour operators, transportation providers, excursion operators, restaurants, activity providers, insurance companies, and other independent suppliers.

However, this limitation does not apply to liability that cannot legally be excluded or limited, including any liability imposed on Vuex Travel by applicable law or arising from conduct for which Vuex Travel is legally responsible.

Vuex Travel’s liability, if any, will be determined under applicable law and the specific services Vuex Travel provided.

  1. NO GUARANTEE OF TRAVEL EXPERIENCE

Vuex Travel does not guarantee that a client’s trip will be uninterrupted, problem-free, safe, satisfactory, or free from delays or changes.

Travel is subject to circumstances that may be outside Vuex Travel’s control.

The Client understands and accepts the inherent risks associated with travel.

  1. REFUNDS

There is no general guarantee of a refund.

Refund eligibility depends upon:

  • The applicable supplier’s cancellation policy;
  • The fare or rate purchased;
  • The timing of cancellation;
  • The reason for cancellation;
  • Applicable law; and
  • Any applicable insurance coverage.

No refund will be issued by Vuex Travel where the Client has no contractual or legal right to a refund from Vuex Travel or the applicable supplier.

Nothing in these Terms eliminates a refund right required by applicable law.

  1. WEBSITE TERMS AND CLIENT ACCEPTANCE

These Terms are posted and made available to Clients through the Vuex Travel website.

Clients are encouraged to review these Terms before completing any booking.

By completing a booking with Vuex Travel, the traveler acknowledges that they have had the opportunity to review, read, understand, and agree to these Terms and Conditions, including the provisions concerning travel requirements, health and personal responsibility, cancellations, refunds, supplier policies, additional expenses, and travel insurance.

The Client acknowledges that travel requirements and supplier policies may change after a booking is made.

The Client accepts responsibility for complying with requirements applicable to the Client and each traveler on the reservation.

The Client acknowledges that travel insurance is strongly recommended as a means of protecting against certain financial losses and unexpected travel circumstances.

  1. APPLICABLE LAW

These Terms are intended to be interpreted consistently with applicable federal and state law.

To the extent permitted by law, Florida law governs these Terms.

If a provision of these Terms conflicts with a mandatory requirement of federal or state law, the mandatory legal requirement will be controlled.

If any provision is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.

  1. IMPORTANT CLIENT ACKNOWLEDGMENT

By completing a booking with Vuex Travel, the Client acknowledges and agrees that:

  • I am voluntarily choosing to travel.
  • I am responsible for my own health, safety, medical decisions, and fitness to travel.
  • I am responsible for the health, safety, documentation, and travel eligibility of the travelers on my reservation to the extent applicable to me.
  • Vuex Travel is not my medical provider and does not provide medical advice.
  • I understand that travel involves risks.
  • I am responsible for complying with applicable passport, visa, entry, health, vaccination, testing, and other travel requirements.
  • I understand that travel requirements may change without notice.
  • I understand that Vuex Travel does not control airlines, hotels, cruises, tour operators, transportation companies, insurance providers, governments, or other third parties.
  • I understand that supplier terms and conditions apply to my reservation.
  • I understand that cancellation fees and penalties may apply.
  • I understand that unused travel services are not automatically refundable.
  • I understand that illness, COVID-19, weather, emergencies, or other circumstances do not automatically entitle me to a refund.
  • I understand that travel insurance is strongly recommended.
  • I understand that Vuex Travel does not determine whether an insurance claim is covered.
  • I understand that I am responsible for reviewing my insurance coverage and submitting claims directly to my insurance provider.
  • I understand that additional accommodations, transportation, meals, medical expenses, quarantine expenses, or other costs may be my responsibility.
  • I understand that Vuex Travel’s responsibility is limited to the travel-agency services it provides, subject to applicable law.
  • I understand that nothing in these Terms eliminates any legal right or protection that cannot lawfully be waived.

By completing a booking with Vuex Travel, I acknowledge that I have had the opportunity to review these Terms and agree to them.
