1. Purpose and Client Responsibility
Vuex Travel (“Vuex Travel,” “we,” “us,” or “our”) provides travel-planning and travel-booking services. By booking travel through Vuex Travel, the traveler (“Client,” “you,” or “your”) agrees to the terms of this policy and the applicable terms and conditions of the airline, cruise line, hotel, tour operator, travel supplier, and other providers involved in the Client’s itinerary.
The Client is responsible for understanding and complying with all travel requirements applicable to their trip.
2. Travel and Health Requirements
Travelers are responsible for obtaining, reviewing, and complying with all requirements applicable to their itinerary, including when applicable:
• Passport and visa requirements;
• Entry and exit requirements;
• COVID-19 and other infectious-disease requirements;
• Vaccination requirements;
• Testing requirements;
• Health certificates or declarations;
• Quarantine or isolation requirements;
• Airline and cruise-line requirements;
• Transit requirements; and
• Requirements imposed by local, state, national, or foreign authorities.
Travel requirements may change at any time and without advance notice.
Vuex Travel may provide available travel information or resources as a courtesy. However, the Client remains responsible for independently verifying the requirements applicable to their trip before departure.
3. No Medical Advice
Vuex Travel and its travel advisors are not medical providers and do not provide medical advice.
Our travel advisors do not diagnose medical conditions, interpret medical test results, determine whether a traveler is medically fit to travel, or determine whether a particular medical or vaccination requirement applies to a traveler.
Clients should consult an appropriately qualified healthcare professional regarding COVID-19, vaccinations, testing, illness, medications, travel fitness, or other medical concerns.
4. COVID-19 and Other Health-Related Restrictions
If a Client is unable to travel because of COVID-19, COVID-19 exposure, another infectious disease, illness, testing requirements, vaccination requirements, quarantine, isolation, government restrictions, airline restrictions, cruise restrictions, destination restrictions, or another health-related circumstance, Vuex Travel is not responsible for the Client’s resulting losses or additional expenses except to the extent expressly required by applicable law or expressly agreed to in writing by Vuex Travel.
Such expenses may include, but are not limited to:
• Additional hotel accommodation;
• Quarantine or isolation accommodations;
• Additional transportation;
• Airline or cruise change or cancellation fees;
• Meals;
• COVID-19 or other medical testing;
• Medical expenses;
• Missed transportation;
• Missed tours or activities;
• Additional nights at a destination;
• Emergency transportation; or
• Other incidental or consequential expenses.
5. Cancellations and Refunds
Vuex Travel does not guarantee a refund, credit, rebooking, or other compensation when a Client cannot travel because of COVID-19, illness, health-related restrictions, government restrictions, airline restrictions, cruise restrictions, supplier restrictions, denied boarding, denied entry, quarantine, isolation, or other circumstances beyond Vuex Travel’s reasonable control.
Any refund, credit, cancellation, rebooking, or other remedy is subject to the written terms and conditions of the applicable travel supplier and the Client’s specific booking.
Where a supplier provides Vuex Travel with a refund or credit that is legally and contractually payable to the Client, Vuex Travel will process the applicable amount in accordance with the supplier’s terms and applicable law.
Vuex Travel’s own service fees, planning fees, administrative fees, or other fees are subject to the fee and cancellation terms disclosed to the Client before payment and are nonrefundable except where required by applicable law or expressly stated otherwise. Nothing in this policy is intended to waive any refund or other right that cannot legally be waived.
6. No Guarantee of Supplier Action
Vuex Travel cannot control the decisions of airlines, cruise lines, hotels, tour operators, insurance companies, governments, airports, or other third parties.
Vuex Travel does not guarantee that a supplier will:
• Issue a refund;
• Waive a cancellation fee;
• Provide a travel credit;
• Permit a date change;
• Provide replacement transportation;
• Provide additional accommodations; or
• Make an exception to its published terms.
Any such decision is made by the applicable supplier or authority.
7. Additional Accommodations and Expenses
If a Client is prevented from traveling or continuing travel because of COVID-19, illness, quarantine, isolation, testing, government restrictions, denied boarding, denied entry, or another circumstance outside Vuex Travel’s reasonable control, the Client is responsible for arranging and paying for any necessary additional services unless another party is contractually or legally responsible for those expenses.
Vuex Travel may, when reasonably possible and at the Client’s request, assist with contacting suppliers or identifying available travel arrangements. Any assistance provided by Vuex Travel does not make Vuex Travel responsible for the resulting costs, losses, or supplier decisions.
8. Travel Insurance
Vuex Travel strongly recommends that every Client purchase comprehensive travel insurance appropriate for the Client’s itinerary.
Clients should carefully review their insurance policy before purchasing it and Determine whether it provides coverage for:
• Trip cancellation;
• Trip interruption;
• COVID-19 or other illness;
• Medical treatment;
• Quarantine or isolation;
• Emergency transportation;
• Missed connections;
• Travel delays;
• Baggage loss or delay; and
• Other risks relevant to the trip.
Vuex Travel does not guarantee that any insurance policy will cover COVID-19, illness, quarantine, cancellation, interruption, or any particular loss.
The Client is responsible for determining whether the insurance purchased provides adequate coverage for the Client’s individual circumstances.
If the Client declines travel insurance, the Client acknowledges that they may be personally responsible for losses or expenses that might otherwise have been covered by insurance.
9. Travel Supplier Terms
Every reservation is also subject to the applicable supplier’s terms and conditions.
The Client is responsible for reviewing the applicable supplier’s cancellation, refund, change, payment, and travel-requirement policies.
Where supplier terms govern the supplier’s services, cancellations, refunds, credits, or changes, those supplier terms apply to the Client’s reservation.
10. Events Beyond Vuex Travel’s Reasonable Control
Vuex Travel is not responsible for delays, cancellations, interruptions, losses, or additional expenses caused by circumstances beyond our reasonable control, including:
• Government actions or restrictions;
• Public-health emergencies;
• Pandemics or epidemics;
• COVID-19 or other infectious diseases;
• Natural disasters;
• Severe weather;
• War or terrorism;
• Civil unrest;
• Strikes or labor disputes;
• Transportation disruptions;
• Airline or cruise-line cancellations;
• Border closures;
• Airport closures; or
• Other extraordinary events beyond Vuex Travel’s reasonable control.
This provision does not eliminate any right or remedy that cannot legally be excluded.
11. Travel Information and Changes
Vuex Travel makes reasonable efforts to provide travel information received from official sources and applicable travel suppliers.
However, travel requirements can change rapidly and without advance notice.
Information provided by Vuex Travel is not a guarantee that a particular requirement will remain in effect through the Client’s departure date.
The Client should verify important requirements with the applicable government authority, airline, cruise line, travel supplier, or other responsible organization before departure.
12. Florida Seller-of-Travel Compliance
Vuex Travel intends to comply with applicable federal, state, and local laws and regulations governing its travel-agency and seller-of-travel activities, including applicable requirements under Florida law.
Florida regulates sellers of travel under the Florida Sellers of Travel Act, including applicable registration and assurance requirements.
Nothing in these terms is intended to waive, limit, or eliminate any consumer right or legal obligation that cannot lawfully be waived or limited.
13. No Waiver of Non-Waivable Rights
Nothing in these terms is intended to:
1. Waive a consumer right that cannot legally be waived;
2. Eliminate a responsibility imposed on Vuex Travel by applicable law;
3. Misrepresent a Client’s legal right to a refund or cancellation; or
4. Excuse fraudulent, intentionally wrongful, or otherwise legally prohibited conduct.
If any provision of these terms is determined to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
14. Governing Law
Unless otherwise required by applicable law, these terms will be governed by the laws of the State of Florida.
Nothing in these terms prevents a Client from exercising rights or pursuing remedies provided by applicable federal, state, or local law.
15. Website Booking and Client Acceptance
This policy is posted and made available to travelers on the Vuex Travel website.
By completing a booking with Vuex Travel, the traveler acknowledges that they have had the opportunity to review, read, understand, and agree to Vuex Travel’s Client Travel Terms, COVID-19 & Travel Restriction Policy, including the provisions regarding travel requirements, cancellations, refunds, additional expenses, and travel insurance.
By completing the booking, the traveler further acknowledges that travel requirements, supplier policies, and government requirements may change after the booking is made and that the traveler remains responsible for complying with the requirements applicable to their trip.
The traveler agrees that refunds, cancellations, credits, changes, and additional expenses are subject to the applicable travel supplier’s terms and applicable law.
